  1. LICENSE AGREEMENT
  2. Berkeley Systems, Inc. grants you a nonexclusive, nontransferable license
  3. to use this screen saver (the "Program") on one computer.  You may install
  4. one copy of the Program onto the hard disk of one computer, and you may
  5. make one copy of the Program disk for backup purposes.  These copies 
  6. must include the After Dark copyright notice.
  7.    This Program, including its graphics displays and its related
  8. documentation, are copyrighted. You may not: rent, distribute or transfer
  9. copies of the Program or documentation to others; modify, reverse 
  10. engineer, disassemble, decompile, or translate the Program or documentation; 
  11. make any copies of the individual module(s) for use with programs; or use 
  12. the Program on more than one terminal of a network, on a multi-user 
  13. computer, on a time-sharing system, on a service bureau, or on any other 
  14. system on which the Program could be used by more than one person at 
  15. a time.

  17. WARRANTY
  18. This license is effective until terminated. You may terminate it at any
  19. time by destroying all copies of the Program. It will also terminate
  20. automatically if you fail to comply with any of the terms and conditions of
  21. this Agreement.
  22.    This Agreement constitutes the entire agreement and understanding 
  23. between the parties and supersedes any prior agreements, representations, 
  24. or understandings, whether oral or written, relating to the Program.
  25.    This Agreement shall be governed by the laws of the State of California.
  26.    Berkeley Systems, Inc. warrants that the documentation and the original
  27. Program disks are free from physical defects in material and workmanship
  28. under normal use for a period of sixty days from the date of purchase. If
  29. during this warranty period you discover that either the documentation or
  30. the Program disks contain a physical defect, return the defective item
  31. along with proof of purchase to your retailer and you will receive a
  32. replacement at no charge. This is your sole and exclusive remedy for
  33. breach.

  35. THE WARRANTY SET FORTH ABOVE IS EXCLUSIVE AND IN LIEU OF ALL 
  36. OTHERS, ORAL OR WRITTEN, EXPRESS OR IMPLIED. BERKELEY 
  37. SYSTEMS MAKES NO WARRANTY OR REPRESENTATION, EXPRESS, 
  38. IMPLIED, OR STATUTORY, WITH RESPECT TO THIS PROGRAM, ITS 
  39. QUALITY, PERFORMANCE, MERCHANTABILITY, OR FITNESS FOR A 
  40. PARTICULAR PURPOSE. THIS PROGRAM IS SOLD AS IS, AND YOU, THE 
  41. LICENSEE, ARE ASSUMING THE ENTIRE RISK AS TO ITS QUALITY AND 
  42. PERFORMANCE.
  43.    IN NO EVENT SHALL BERKELEY SYSTEMS OR C-2 OFFICE GEAR BE 
  44. LIABLE FOR DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, OR 
  45. CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OF THE PROGRAM 
  46. OR FROM ANY ERROR OR DEFECT IN THE PROGRAM OR ITS 
  47. DOCUMENTATION. SUCH  DAMAGES INCLUDE, BUT ARE NOT LIMITED TO, 
  48. LOSS OF PROFIT, LOSS OF PROGRAMS OR DATA, AND DAMAGE TO YOUR 
  49. MONITOR. IN NO EVENT SHALL LIABILITY EXCEED THE PRICE OF THE 
  50. PROGRAM.
  51.    The above exclusions may not apply to you. This warranty provides you 
  52. with specific legal rights. There may be other rights that you may have 
  53. which vary from state to state.
